Effective July 1, 2024. Delaware House Bill No. 285: Expanding Access to Medical Marijuana Overview On December 13, 2023, Delaware’s General Assembly introduced House Bill No. 285, a significant amendment to the state’s medical marijuana regulations. We are pleased to announce that this bill has passed, marking a transformative step forward in medical marijuana access for Delaware residents. Here’s a breakdown of what this new law entails and how it could impact you. 

Highlights:

  • “HB285 removed the requirement that a patient have a debilitating medical condition to qualify for a registry identification card, instead allowing health care providers to make the determination of whether a patient has a diagnosed medical condition for which the patient would receive therapeutic or palliative benefit from the use of marijuana.”
  • “HB285 also removes the CBD-rich and compassionate use programs, which previously allowed for the use of marijuana for the treatment of conditions that otherwise did not qualify a patient for a medical marijuana card.”
  • “HB285 allows patients aged 65 and older to self-certify their qualification for a medical marijuana identification card without written certification from a health care provider.”
  • “HB285 authorizes the medical marijuana program to issue registry identification cards with 1,2-, or 3-year expiration dates.”
  • “HB285 also requires the issuance of a registry identification card with an indefinite expiration date if the patient has a terminal illness.”
  • “HB285 allows individuals with out-of-state medical marijuana identification cards to make purchases in Delaware dispensaries. These individuals will be given a link to register their out-of-state medical marijuana identification cards in Biotrack. Once completed, the system will provide them with a code to download their reciprocity identification card. The expiration date for the reciprocity identification card will match their out-of-state ID. The out-of-state patients will have the same purchase limits as our Delaware patients.”
